Welcome to my website and online shop! These Terms of Service outline the rules and conditions for using my website and purchasing artwork, prints, merchandise, and other products from my shop.

By accessing or using this website, placing an order, or purchasing a product, you agree to these Terms of Service and my Return & Refund Policy. Please read them carefully before making a purchase.

🐾 1. About My Shop

This website is operated by independent artist Ginger Reynolds. Through this shop, I offer original artwork, art prints, merchandise, and may offer custom pet portraits or other artistic services.

I am an independent artist, and many of my products are created, printed, or fulfilled specifically for each order. Because of this, products and policies may differ from those of larger retailers.

🎨 2. Artwork & Product Information

I make every effort to accurately represent my artwork and products, including colors, dimensions, materials, and other details.

However, colors may appear slightly different depending on your monitor, screen settings, lighting, or device.

Original paintings are one-of-a-kind works of art. Minor variations, brushstrokes, textures, imperfections, and other characteristics are part of the nature and beauty of handmade artwork and should not necessarily be considered defects.

Product photographs are intended to provide a representation of the item and may not perfectly reflect its actual appearance.

🖼️ 3. Original Artwork

All original artwork is one-of-a-kind and is final sale unless otherwise required by applicable law.

Once an original painting has been purchased and delivered, it cannot be returned simply because you have changed your mind, no longer want the artwork, or feel that the artwork does not match your expectations.

Please review all available photographs, descriptions, dimensions, and other information before purchasing.

🖨️ 4. Prints & Merchandise

Many prints and merchandise items are produced specifically after an order is placed.

These items are generally final sale and cannot be returned or refunded because of a change of mind, incorrect size selection, buyer's remorse, or similar reasons.

If an item arrives damaged, defective, misprinted, or incorrect, please contact me within 7 days of delivery. Please provide your order number and photographs of the item and packaging so that I can determine the appropriate resolution.

🐱 5. Custom Pet Portraits

If custom pet portraits or other commissioned artwork are available for purchase, each commission is created specifically for the customer.

Customers are responsible for providing accurate photographs, reference materials, names, instructions, and other information needed to complete the artwork.

Because commissioned artwork is created specifically for you, deposits and completed commissions may be non-refundable, except where otherwise required by applicable law or agreed upon in writing.

I reserve the right to decline a commission at my discretion.

Additional information regarding the custom artwork process, pricing, revisions, deposits, and delivery will be provided when applicable.

📍 6. Shipping Addresses

You are responsible for providing a complete and accurate shipping address at checkout.

Please carefully review your shipping information before placing your order, including your name, street address, apartment or unit number, city, state, ZIP code, and country.

I am not responsible for orders that are delayed, lost, returned, or delivered incorrectly because an incorrect or incomplete address was provided by the customer.

Orders shipped to an incorrect address provided by the customer will not be replaced or refunded.

If you realize that you entered an incorrect address, please contact me immediately. I will do my best to assist if the order has not yet entered production or shipping, but I cannot guarantee that an address can be changed after an order has been processed.

💳 7. Pricing & Payment

All prices are listed in U.S. dollars unless otherwise stated.

Prices, product availability, and product details may change at any time without notice.

Payment must be successfully processed before an order is considered confirmed.

I reserve the right to correct pricing, product description, or listing errors and, when appropriate, cancel an order affected by an obvious error.

📦 8. Order Acceptance & Cancellation

Placing an order does not necessarily guarantee that the order will be accepted.

I reserve the right to cancel or refuse an order when necessary, including in cases involving suspected fraud, incorrect pricing, unavailable products, technical errors, or other circumstances that prevent the order from being fulfilled.

If an order is canceled by me, you will receive a refund for the amount paid for that order.

Customers may request cancellation as soon as possible after placing an order. Because many products are made to order, cancellation or changes may not be possible once an order has entered production or shipping.

🚚 9. Shipping & Delivery

Shipping times are estimates and are not guaranteed unless specifically stated otherwise.

Once an order has been shipped, delivery is handled by the applicable shipping carrier and/or fulfillment provider.

I am not responsible for delays caused by circumstances outside my reasonable control, including carrier delays, weather, natural disasters, customs delays, incorrect addresses, holidays, or other unforeseen circumstances.

If a package is shown as delivered but cannot be located, please first check with household members, neighbors, your building's mail area, and the applicable carrier.

🧡 10. Intellectual Property & Copyright

All artwork, paintings, photographs, product designs, illustrations, graphics, logos, written content, website content, and other creative materials displayed on this website are owned by or licensed to Ginger Reynolds unless otherwise stated.

Purchasing artwork or merchandise does not transfer copyright or intellectual property rights to the purchaser.

You may not reproduce, copy, scan, trace, modify, distribute, resell, commercially exploit, or create derivative works from my artwork or other copyrighted content without my prior written permission.

This includes reproducing artwork for prints, merchandise, digital products, social media graphics, websites, NFTs, AI training datasets, or other commercial or personal purposes.

The purchase of an original painting or print gives you ownership of the physical item only; it does not give you ownership of the copyright.

📸 11. Artist's Rights

I retain the right to photograph and display artwork I have created for my portfolio, website, social media, marketing, exhibitions, publications, and other promotional purposes, including artwork created as commissions, unless a separate written agreement states otherwise.

Purchasing an original artwork or commissioning a custom piece does not automatically transfer copyright or reproduction rights.

Unless otherwise agreed in writing, artwork and merchandise purchased through this website are intended for personal use.

You may not purchase artwork or products for the purpose of reproducing, copying, manufacturing, or commercially exploiting the artwork without my written permission.

You agree to use this website only for lawful purposes.

You may not use the website in a way that could damage, disable, overburden, or interfere with the website or its operation.

You may not attempt to gain unauthorized access to the website, its systems, accounts, databases, or other related services.

🔗 14. Third-Party Services

This website may use third-party companies and services to process payments, manufacture products, fulfill orders, provide shipping services, host content, analyze website traffic, or otherwise operate the shop.

Your use of those services may also be subject to the third party's own terms and policies.

🐾 15. Supporting Pets Through Art

A portion of proceeds from qualifying sales may be used to support pets, pet parents, ferals, strays, rescues, or other animal-related needs.

When a product or promotion specifically states that a portion of its proceeds supports a particular cause, the contribution will be made according to the terms described in that product or promotion.

Unless specifically stated otherwise, purchasing a product does not constitute a charitable donation, and the purchase price should not be represented as a tax-deductible charitable contribution.

To the fullest extent permitted by applicable law, I will not be responsible for indirect, incidental, special, consequential, or other damages arising from your use of this website or the purchase or use of products obtained through this website.

Nothing in these Terms of Service is intended to exclude or limit any rights or protections that cannot legally be excluded or limited under applicable law.

I may update or modify these Terms of Service from time to time.

Any changes will become effective when the updated Terms of Service are posted on this website. Your continued use of the website or purchase of products after changes are posted constitutes acceptance of the updated terms.

These Terms of Service shall be governed by and interpreted in accordance with the laws applicable to the State of Oklahoma, without regard to conflict-of-law principles, except where applicable law requires otherwise.
